PREREQUISITE
POLYMEDO SASU welcomes you to its website. The User confirms having read, understood and accepted all Legal Notices and Terms of Use in their entirety prior to any use of the Site and undertakes to comply with them. In the case of minor Users, their parents or legal guardians are deemed to have accepted these Terms of Use on their behalf.

 

1.  IDENTIFICATION

This website, accessible at https://www.polymedo.fr (hereinafter the "Site"), is published by POLYMEDO SASU with a share capital of €2,000, whose registered office is located at 29 rue Lécluse, 75017 Paris, registered with the Paris Trade and Companies Register under number 814 123 170 (hereinafter "POLYMEDO").

The Site was designed and developed by POLYMEDO. The Site is hosted by: GOOGLE LLC, a company whose registered office is located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; the e-commerce platform is powered by Shopify Inc., a Canadian company listed on the TSX and NYSE – Registration No. 426160-7 – Address: 151 O'Connor Street, Ground Floor, Ottawa, Ontario K2P 2L8, Canada.

This website is the exclusive property of POLYMEDO SASU.

2.  GENERAL INFORMATION — PRESENTATION AND CONTENT OF THE SITE

  • Access to the Site, its use and its content are governed by these Terms of Use. Any access to and continued browsing of the Site constitutes express and unreserved acceptance of all these Terms of Use by the person visiting and/or using the Site (hereinafter the "User").

  • The current online version of these Terms of Use is the sole version enforceable for the duration of use of the Site and until replaced by a new version. The Terms of Use may be modified at any time and without notice. The Terms of Use are deemed accepted without reservation when you connect to the Site. 

  • The information, content and features on the Site are provided for information purposes only and may be revised at any time and without notice. POLYMEDO is entitled, without prior notice to the User, to make any modifications it deems appropriate.

    POLYMEDO does not guarantee in any way that the contents, data and information accessible on the Site are accurate, precise, exhaustive or up to date.

    POLYMEDO also reserves the right, without prior notice to the User, to modify or improve, suspend or delete existing features or add new features.

    • Access to and use of the Site are reserved for strictly personal use. The User undertakes not to use the Site and the information or data contained therein for commercial, political or advertising purposes or for any form of commercial solicitation.

    • Users are not authorised to create a hyperlink to the Site and/or any page of the Site and/or any file therein without the prior written consent of POLYMEDO. In such a case, POLYMEDO cannot under any circumstances be held liable for the content of third-party websites featuring such a link. POLYMEDO reserves the right to request the removal of any link it deems inconsistent with the purpose of its website.


    3.  LIABILITY AND INTELLECTUAL PROPERTY

    All content on the Site (including without limitation videos, images, photographs, logos, software, graphics, documents and all other data) is protected by intellectual property and artistic rights legislation in force in France and by international conventions.

    Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of any of these elements is strictly prohibited without the express written consent of POLYMEDO. Any such representation or reproduction, by any means whatsoever, constitutes an infringement of copyright punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

    Failure to comply with this prohibition constitutes an infringement that may give rise to civil and criminal liability on the part of the infringer.     In addition, POLYMEDO, as the owner of the copied content, may bring legal proceedings against you.
    These Terms of Use do not constitute any assignment of or licence to any intellectual property right in favour of the User, other than the right to use the Site in accordance with all provisions of the Terms of Use.
    The fact that POLYMEDO does not initiate proceedings upon becoming aware of unauthorised uses does not constitute acceptance of such uses or a waiver of legal action.
     

    4.  ACCESS TO THE SITE

    • To access the Site, the User must have an internet connection. POLYMEDO undertakes to use all reasonable means at its disposal to make the Site accessible to Users at all times, except during maintenance periods. However, POLYMEDO does not guarantee uninterrupted access to the Site.

    Access to the Site may be slowed or temporarily interrupted. POLYMEDO may at any time suspend, interrupt or limit access to all or part of the Site, or reserve access to the Site, or to certain parts of the Site, to a specific category of internet user, for technical reasons, due to failures or disruptions in telecommunications systems beyond POLYMEDO's control, or for service-related requirements, in particular to ensure maintenance of POLYMEDO's servers, maintenance and updates to the Site, etc., or when POLYMEDO identifies a security vulnerability that could seriously compromise the security of Data and/or the POLYMEDO server. POLYMEDO's liability may not be engaged on this basis.

    • POLYMEDO's liability may not be engaged in the event of failure, breakdown, difficulty, slowdown or interruption preventing access to the Site or to any of its features, and it does not guarantee uninterrupted access to the Site.

       

    5.  PERSONAL DATA

    The data and information you transmit to POLYMEDO, in particular when browsing the Site or completing any form, include personal data, the collection and processing of which by POLYMEDO are governed by the Personal Data Processing Policy accessible on the Site. By using the Site, the User accepts that POLYMEDO cannot be held liable for their use of third-party websites and social networks. By clicking on a link to a third-party site, the User understands that they are leaving the Site governed by these Terms of Use and accepts that POLYMEDO does not control those third-party websites. In particular, POLYMEDO cannot guarantee that a third-party site adheres to the same security and confidentiality practices as POLYMEDO. POLYMEDO shall therefore not be held liable for the use that may be made of Users' personal data by such sites.     8.  LIMITATION OF LIABILITY — USER OBLIGATIONS

    • POLYMEDO shall under no circumstances be held liable to anyone for any direct or indirect damage caused to the User, third parties and/or the User's equipment, including without limitation viruses, computer defects or malfunctions, fraudulent third-party intrusion, loss of clients, profits, revenue, opportunities or data, any errors, omissions, losses or delays, whether the damage is caused during, in connection with or as a result of use of the Site or any content or other element accessible or downloaded from the Site.

    POLYMEDO does not guarantee in any way that the Site is free from malicious computer code, including but not limited to computer viruses. POLYMEDO's liability may not be engaged in the event of damage to or deletion of data caused by malicious computer code.

    • The User is solely responsible for their use of the Site, all of its features and all data and information they communicate or transmit via the Site, and for any other action taken on the Site, in particular when completing any online form.

    The User warrants to POLYMEDO that their activity carried out on and via the Site shall not contravene any applicable law or regulation. POLYMEDO cannot be held liable for any activity of the User on or via the Site and/or for any direct or indirect damages arising from the User's use of the Site and all of its data.

    The User indemnifies POLYMEDO against any claim or action by third parties in this regard.

    The User acknowledges and accepts that POLYMEDO has no obligation to monitor or control the data and information transmitted by the User on the Site.
    The User undertakes not to, directly or indirectly, disparage the Site and/or POLYMEDO's services or POLYMEDO on social media or through any other means of communication.

    Each User is responsible for taking all measures necessary to protect the data and software stored on their computer, in particular against contamination by viruses or spyware that could be introduced by third parties via the internet.

    The User declares acceptance of the characteristics and limitations of the internet, and acknowledges in particular that: POLYMEDO assumes no responsibility for services accessible via the internet and exercises no control whatsoever over the nature and characteristics of data that may transit through its server centre.

    The User acknowledges that data circulating on the internet is not protected, in particular against potential misappropriation. Any communication of information deemed by the User to be sensitive or confidential is made at the User's own risk.

    The User acknowledges that data circulating on the internet may be subject to usage regulations or protected by a proprietary right. The User is solely responsible for the use of data they consult, query and transfer on the internet.
    The User undertakes to use the Site's services and all information to which they may have access only for purposes consistent with public order, morality and the rights of third parties.
    The User undertakes not to commit any act that could jeopardise the IT security of the Site or the IT systems of other users.
    The User undertakes not to interfere with or disrupt the normal operation of the Site.

    Any content downloaded is done so at the User's own risk and sole responsibility. Consequently, POLYMEDO shall not be held liable for any damage suffered by the User's computer or any data loss resulting from the download.

    Access to the Site may require the use of personal access codes. These means of authentication are personal and confidential. You must keep them secret and may of course modify them at any time.

    POLYMEDO reserves the right to take legal action against any infringing User in order to obtain redress for the harm suffered.

    • Any warranty of quality or fitness for a specific purpose is expressly excluded.
    • The User is fully aware of the provisions of this article and in particular the aforementioned limitations of liability, which are essential conditions of these Terms of Use.

     

    9.  APPLICABLE LAW — DISPUTES 

    These Terms of Use are governed by French law. They are written in French. Should they be translated into one or more languages, only the French text shall prevail in the event of any dispute.

    Any claim or dispute arising from the validity, interpretation or performance of these Terms of Use shall be submitted to the competent courts within the jurisdiction of the Paris Court of Appeal, under ordinary law conditions.
